    RULES AND REGULATIONS (BROKER/CLIENT REFERRAL POLICY)

    We are pleased to offer a referral fee to cooperating Brokers who bring Purchasers to our participating communities. We do not pay referral fees to Brokers who are retained by Purchaser after the Purchaser has visited our participating communities or has registered with our participating communities. Also, referral fees are paid only for Purchasers who close escrow. To be eligible, Broker and Purchaser (the “Client”) must adhere to the terms below:

    1. Broker must register Client on or before Client’s first interaction with Community.
      1. Broker can register Client by fully completing the Broker Registration Card, available through our Sales Office; or by phone, fax, online registration or email. Before registering Client, Broker should confirm that Client has not already registered with Community.
      2. Client’s first interaction with our Community can take several forms, such as visiting our Community or registering online.
      3. Broker is responsible for documenting that Broker has satisfied these requirements.
      4. Only registrations fully completed by both Purchaser and Broker on a timely basis will be accepted.
    2. No subsequent Broker registrations will be allowed for Clients registered by on-site sales staff with no broker upon their first visit.
    3. Broker will be paid the referral fee through the Escrow company upon close for sales written with Broker’s Client, within 90 days of the date of broker registration, provided the registration occurred upon the Client’s first visit.
    4. If more than one Broker registers the same Client, the referral fee will be paid to the Broker who is confirmed by the Client/Purchaser at the time of sale regardless of the order of registration.
    5. Broker will not represent the Client/Purchaser as their agent in this transaction. Seller Representatives will communicate directly with Purchaser and Purchaser is solely responsible for all communications with their Lender and the Seller.
    6. Seller Representatives will complete all of the necessary paperwork, including written offers, execution of the contract, Escrow follow-up, and administration of the purchase transaction.
    7. All referral fees are subject to verification that Broker and Broker’s Representatives hold valid and active real estate licenses in the State where the Community resides at time of purchase.

    When you use Warmington’s Referral Program contingency assistance program in conjunction with arranging financing through one of Warmington Residential’s lenders of choice, your entire original escrow deposit will be fully refundable should we be unable to sell your existing home in a specified time period that is tied to the anticipated close of escrow on your new Warmington home. (Be advised that deposits on upgrades and options are non-refundable.)

    *Consistent with California energy regulations, new homes must be equipped with solar panels. Solar panels are not included in the posted price, but may be leased for a monthly payment, or purchased for an additional cost that may be eligible for mortgage financing. The required size of the solar system depends on several factors, including, but not limited to, home size, local utility rates and climate zone.
